Allodial Title

Minnesota State Constitution ( Article 1, Sec. 15) grants us the right to have the American Dream of a homestead under an allodial title. That simply means that there are no “superiors” that can take away that right.

However, the Minnesota homestead property tax laws are in conflict with the allodial title concept of ownership. The laws usurp our State Constitution by placing the government as the “superior” over the sovereign rights of the property owners. In that position, the government has the ultimate right of possession or the authority to impose what amounts to a mandatory user fees for our homesteads. Such juxtaposition is the hallmark of a feudal style ownership that has been specifically prohibited by our State Constitution.

The dark side is that we are subjected by a rogue tax to sustain our local government services. But the bright side is that the rogue tax can be rehabilitated to join the family of fair and just taxes. However, before suggesting a solution, I anticipate there may be readers of my blog who don’t agree with the characterization of the homestead property tax as being rogue. For those skeptics, I will post blogs to illustrate that there is no other tax as aggrieving as the homestead property tax.

I view the “Property Tax Justice - Minnesota”  blog as a place for members to vent their grievances and frustrations about the property tax. But most of all, I hope that this will become a SUPPORT-ACTIVIST- LOBBY group to accomplish the MISSION of fair and just homestead property taxes.

    1. Anonymous, that is because homestead law is not taught to law students. I have verified with all the Law Schools in Minnesota that there is no formal course on homestead property taxes for law students. Also, I have looked at past Bar Exam questions. None of the exams have questions on homestead property taxes. Some people have attempted to find attorneys that would address the constitutional question. But all of the attorneys that have been contacted have had various excuses why they won’t address the issue. Now that I have learned the extent of their formal training on homestead property taxes, it is no wonder that they feel as comfortable as fish out of water.

  2. I agree that the property tax is a rogue tax. In fact, I could think of many other adjectives to describe it that are not as polite.

    1. A rogue tax. So, you want services paid for by the tax but you don't think you should pay anything. OK. Got it.

  3. We have the right to own property, how can our rights be taxed? Our State constitution is clear all lands to remain allodial, beholden to no one. It states that the way things are now are prohibited. Do you ever wonder why things are referred to in Latin? Because the Latin language is never changes unlike our English multi-definition for every word for our government's self-interest

    1. Taxing your right? WTF are you talking about. Your rights are NOT being taxed. If you own property, you are taxed to pay for services. But you thing those services should be free, to just you. SURE. Whatever.

      It sounds as if you relish in the fact of having to pay one’s taxes and for that the crown thanks you. What you’re forgetting is, owning land is a god given right, not a privilege. God given rights should never be taxable and where the government gets us all is when we agree to there terms. At the contractual moment, we’ve just conceded to their jurisdictional control. The states, if for some crazy reason, decide to run their state like a business, ( and they should because their all incorporated) and start to assume some fiscal responsibility, while the people decide how to spend their money ( through elected officials that truly represent their constituents ). Until then, I thank you for your willingness to wanna pay your taxes.

  4. And I'm not anonymous, my name is Jim Stodola, my family is a victim of a tyrannical County and State government I don't have anything to hide unfortunately for them they have nothing that can be hid.
